The burden of proof rests on the businesses first placing products on European markets.

Due Diligence

EUDR mandates operators to conduct due diligence to prove that the products are deforestation-free, were produced in accordance with local laws and where applicable, with the consent of indigenous peoples. 

Due Diligence Statements must be filed prior to placing relevant products on the market or exporting them.

Efficient and secure information collection, storage, evaluation, assurance and permission-based sharing requires a digital solution.

Ongoing Risk Monitoring

The regulation mandates that operators conduct risk assessments and implement mitigating actions to ensure zero or negligible non-compliance risk exists for products.  Also required is ongoing risk monitoring, management and regular effectiveness assessment.

Operators need to monitor material change in large data sets across multiple chain of custody parties for each product supply chain.

Verifiable Evidence

Companies must assemble, hold and share ‘conclusive and verifiable’ information and evidence proving their products meet regulatory requirements.  This includes product information, the geolocations of all production plots of land, deforestation-free proof and local law compliance proof.

Information, evidence and change histories need to be readily accessible for audit, assurance and regulatory scrutiny.  Sensitive information must remain secure but made available with permissioned access by disparate sets of data owners.

Governance and Controls

Operators shall adopt adequate policies, controls and procedures to mitigate and manage risk to achieve zero or negligible risk of non-compliance.  This includes examination of product handling from harvest through the chain of custody.

Evidence of product handling as well as governance and controls infrastructure should be available from each party in each product’s chain of custody.

Relevant products are guilty until proven innocent.

Penalties for non-compliance

  • Fines up to 4% of EU turnover
  • Relevant product confiscation
  • Temporary EU market access prohibition
  • 12 month ban from public procurement
  • Exclusion from public funding
  • Named in a public register
Non-compliance penalties are designed to be effective, proportionate and dissuasive including fines proportuionate to the environmental damage and the value of the relevant commodities or products.
